Unlike traditional accountants who are governed by auditing/ financial reporting standards in performing their duties, forensic practitioners need to exercise reasonable judgment without the guidance of specific standards when carrying out their duties. In this respect, soft skills and critical thinking are pivotal for them in ensuring the quality of their work. In this interactive face-to-face event, the speakers will talk about a number of essential traits and characteristics that forensic accountants should possess, such as being analytical, detail-oriented, ethical, responsive, insightful, and sceptical. On top of this, forensic accountants must be effective communicators, as they need to present their findings clearly and persuasively to various different parties. Their audiences include clients and judges, who may be considered laymen in this field, and may not be familiar with technical terms in the relevant reports.

The Personal Data (Privacy) Ordinance strives to protect the privacy interests of living individuals in relation to personal data, which has an impact on all walks of life. Over the past couple of years, the government has been strengthening its efforts to protect personal data privacy and prevent abuses of personal information, including through prosecutions and the introduction of new legislation, such as anti-doxing laws. At the same time, professionals, such as forensic accounting and insolvency practitioners, who may need to gain access to personal for legitimate reasons, may find their work affected by these changes.

Topic:

Layered Voice Analysis (LVA) monitors the uncontrolled parameters of the human voice that emerge when a person speaks. This Genuine Emotion Detection identifies the 151 micro markers within the words spoken.

It doesn’t matter how you speak (whether you are acting angry or calm) or what language you speak in, it is language agnostic and is indifferent to any expressed tonality. The technology only monitors how you genuinely feel in a certain situation.

LVA identifies the unique patterns in the human voice, patterns that we as persons have a difficulty to identify on our own. Through 25 years of research, the technology has learnt to identify and correlate with these key human emotions to show us what the other side really feels.

Speaker:

James Ellender has worked in the risk, intelligence and security industries for over 20 years. Initially spending 12 years as a PIP accredited specialist detective in UK law enforcement, he developed an extensive understanding of the planning and execution of covert and conventional investigations. He also has experience in handling financial crime, narcotics cases, and counter-terrorism operations as well as holding a Masters of Science (Msc) in Risk, Crisis and Disaster Management from the University of Leicester.

Since 2012, he has been assisting governments, multi-national organisations and individual clients on a case-by-case basis. Most recently, he helped develop behavioural analysis techniques for the 2022 FIFA World Cup security team.

He also regularly delivers corporate training and public speaking engagements in the areas of behavioural detection, the science of interviewing, corporate security awareness, risk mitigation and crisis management.

Carolyn Law is an Analyst in Control Risks’ Shanghai office. Carolyn is responsible for delivering and developing Control Risks’ analytical products and consulting in the areas of political, integrity, security and operational risks across Northeast Asia.

Carolyn was previously a Compliance Analyst for Credit Suisse, where she handled enquiries from Singapore and Hong Kong financial regulators. She is a native of Hong Kong and has experience living in Taiwan and Singapore.

Carolyn speaks Cantonese, Mandarin, English and Japanese.

Neal Beatty is a Principal in Control Risks’ Hong Kong office. In this role, he is responsible for client relationships in Hong Kong, developing new business with multinational clients, and advising on areas of business risk that impact their operations in Hong Kong, Greater China and the Asia Pacific region.

Neal also consults with clients on issues relating to strategic risk management and crisis preparedness, including restructuring and reputational issues. He has assisted clients dealing with sensitive internal compliance and business continuity issue and regularly conducts crisis management workshops with senior management groups. A fluent Mandarin Chinese speaker, Neal regularly gives presentations to both MNC and Chinese companies on a range of business risk-related issues.

Neal holds a Master’s degree in Chinese Studies from the University of Leeds and a BSc in chemistry from Warwick University, both in the UK.

ASIS Hong Kong Chapter is organising an online seminar featuring the Executive Director of Institute of Strategic Risk Management in the crisis handling post terrorism attack, using a case sharing of the Manchester Arena suicide bombing which took 23 lives including the attacker, and injured 1017 people.

Speaker

Dr David Rubens is the CEO of the Deltar Group and Executive Director of the Institute of Strategic Risk Management (ISRM), which he founded in 2018. He is a recognised authority on the strategic management of complex events, particularly within a multi-agency crisis management framework.

David holds a doctorate in security and risk management from the University of Portsmouth, writing his thesis on alternative command & control frameworks for strategic management and critical decision-making in complex crisis environments. He has been a Visiting Lecturer and Dissertation Supervisor on the Leicester University ‘Security, Policing and Terrorism’ MSc programme, and a Visiting Lecturer on the Strategic Leadership programme at Cranfield University, where he lectured on terrorism and public policy, and strategic management of complex operations. He is currently a Visiting Lecturer on the International Security Management Masters programme at the Berlin School of Economics and Law.

David contributed to the UK Critical Infrastructure Resilience Executive Steering Committee as a Subject Matter Expert for the strategic management of complex crisis management and was a founding member of the London Resilience Gold Command Crisis Management Project Academic Advisory Group. He is currently a member of the UK National Preparedness Commission. Dr David Rubens was voted the IFSEC No 1 Global Security Thought Leader of 2019.

Abstract: Johnny, CFO of Moon travel company received complain letter that SpaceShip company did not receive the payment for over 2 months after submitting the invoices. But Johnny confirmed with his bank that the payment has already been made. How come!!! What happen? Is that insider problem? Is that due to external hacker? Is SpaceShip company cheating?

You are being invited to help him to conduct the investigation.

Within this hands-on workshop, we will cover two main parts – Day 1 (Acquisition) and Day 2 (Investigation and Analysis). So in Day 1 of the workshop, we will guide you from incident management, containment and identification of evidence. Then we will perform forensics acquisition from memory, computer disk, cloud computing environment through a number of demonstration and lab sessions. We will also explain the pitfalls and challenges in forensics acquisition.

On Day 2, we will switch our role to act as investigator. We will then understand where and what we can find and extract from various artefacts from Windows System, user profiles, files, network and emails. Ultimately, as Holmes, we will have to reconstruct and reassemble broken pieces of artefacts to become a reasonable case.

Digital Forensics can be fun if we know how to perform the steps with appropriate skills.

Christopher Salgado is a highly accomplished and trusted security and investigations leader with more than 19 years in cyber and physical investigations. Throughout his career, he has assisted Fortune 50 companies including via the installation of numerous innovative and efficient processes in the topics of investigations, security, brand protection, threat management, business continuity, intelligence, operations, recruiting, customer service, employee morale and leadership. HKICPA ForensIG E-learning webinar - Narrowing the audit expectation gap in relation to fraud and going concern (22 Jan 2021)

The next event organised by the HKICPA ForensIG will be a panel discussion held on 22 January, 2021, at which experienced forensic, audit and legal practitioners, will consider the International Auditing and Assurance Standards Board (IAASB)’s recently-issued discussion paper on issues and challenges relating to the gap between what users of the financial statements expect and the realities of the financial statement audit.

The discussion will cover:

What are possible ways to narrow the gap?
Should forensic accountants be engaged to help narrow the expectation gap and would there be any potential implications for auditors’ liability?
Should more communication and education be directed at shareholders/ investors? Should they even be engaged during the audit planning stage?
Should the current standards/ regulations be amended?
Introduction of the paper
Elements of the audit expectation gap, including the knowledge gap, in terms of the expected role of auditors, the performance gap between work done and requirements, and the evolution gap, i.e., how audit needs to continue to develop.
Which parties should assume responsibilities regarding fraud and going concern? Management, audit committees, auditors or regulators?

He is a director of Hong Kong Private Equity Finance Association (“HKPEFA”) which aims to promote the private equity and venture capital industry in Hong Kong. He is also one of the admission panel members of the Incubation Program of Hong Kong Science and Technology Park (“HKSTP”).

An increasing number of Cayman Islands incorporated companies are being de-listed from public stock exchanges through a “take-private” process, and may subsequently be re-listed elsewhere.

In the course of privatizations, the consideration paid by de-listing companies to dissenting public shareholders can be challenged under the Cayman Companies Law. Shareholders are entitled to seek payment of the “fair value” of their shares, as determined by the Cayman Islands Grand Court, instead of the offer made by the company.

In this joint ForensIG – Restructuring and Insolvency Faculty webinar, Ian Mann, a partner at Harneys and regular speaker at Institute events, who has been involved in a number of the leading cases, will:

introduce the statutory take-private process;
explore the underlying legal principles, including “fair value” valuation methodologies; and
discuss the relevant case law in the Grand Court, Court of Appeal and Privy Council.
